Who are food business operators?
"The natural or legal persons responsible for ensuring that the requirements of food law are met within the food business under their control". This definition of operator goes beyond "proprietor" and may also include the person in charge of the business e.g. a manager.
HACCPRegulations
The Food Hygiene (England) Regulations 2005 (and similar Regulations covering Scotland, Wales and Northern Ireland) came into force on 1st January 2006. All food businesses will then be required to have a documented Food Safety Management system in place and maintain written records. Food business operators will need to establish and operate food safety programmes and procedures based on HACCP principles. (Hazard Analysis and Critical Control Point.) HACCP is an internationally recognised system that helps to ensure the safety of food prepared and sold.
Food Hygiene Training
Food hygiene instruction and/or training is a legal requirement for food handlers. The Food Hygiene Regulations require all food handlers to be supervised and instructed and/or trained in food hygiene matters. In general, the law will be complied with if those who handle or prepare high-risk open food (such as chefs, cooks, delicatessen staff etc.) complete formal training to a specified level within 3 months of starting work.
European Food Legislation
The European Food Regulations EC Regulation 178/2002 were established in 2002 and provide the general principles for European food law. Some of the key requirements were enacted by the UK General Food Regulations 2004 which came into force on 1st January 2005. The aim of these Regulations is to protect health and consumer interest in relation to food. They establish guiding principles and objectives for food law to ensure high standards throughout.
